Hiring the right person can decide whether a company grows or stalls. When the right candidate happens to be a foreign national, that hire comes with eligibility rules, government filings, hard deadlines, documentation and compliance obligations that don't forgive guesswork.

Kanu & Associates, P.C. helps employers, entrepreneurs and investors understand their business immigration options and move forward with a clear legal strategy. We serve businesses in Arizona, New Mexico and beyond with employment-based immigration guidance, employer compliance support, and representation before the appropriate government agencies. Business immigration is more than paperwork — it's workforce planning, compliance and business strategy.

Immigration Solutions for Employers

Employers come to us for all kinds of reasons. A company wants to hire a skilled professional. A key employee needs to transfer. A valuable worker's status is running out. A business owner wants to sponsor someone for permanent residence, or build an immigration plan that covers the next several years of hiring. We help you evaluate the options and understand the requirements before the process starts, when choices are still cheap to change.

  • Employment-based visa strategy
  • H-1B petitions
  • H-2A agricultural worker matters
  • H-2B temporary nonagricultural worker matters
  • Employment-based immigrant petitions
  • PERM-related guidance and case planning
  • National Interest Waiver strategy when appropriate

  • Requests for Evidence
  • USCIS filings
  • DOL and FLAG-related filings

H-1B, H-2A and H-2B Hiring

The H-1B process can help employers fill specialty occupation positions that generally require specialized knowledge and appropriate educational qualifications. These cases turn on careful documentation: the offered position, the employer's business need, the worker's credentials, wage requirements, and the connection between the job duties and the required degree field. We help employers put together organized, well-supported H-1B filings and respond when the government asks for more.

Other businesses need temporary or seasonal workers to meet labor demands. The H-2A program may assist qualifying agricultural employers, while H-2B may assist certain employers with temporary nonagricultural labor needs. Both involve detailed government requirements, tight timing, recruitment steps, wage obligations and documentation. We walk employers through the sequence and prepare filings with close attention to compliance.

Green Cards, Investors and Entrepreneurs

For employers who want to keep a valuable foreign national worker long term, employment-based permanent residence may be an option. These cases need strategic planning, detailed documentation and real coordination between the employer and the employee. Our firm assists with employment-based immigrant petitions, case planning, evidence preparation and related strategy, including National Interest Waiver strategy where it fits.

Business immigration isn't limited to companies hiring workers. Entrepreneurs and investors may have options based on business ownership, investment, job creation or specialized business plans. We help investors and entrepreneurs evaluate potential strategies and prepare documentation that supports the business purpose, investment activity, operational plans and eligibility requirements.

Requests for Evidence and Employer Compliance

A Request for Evidence rattles everyone — the employer and the employee both. An RFE may challenge job duties, your business operations, the wage level, the employee's qualifications, worksite details or any other part of the filing. We help employers answer with organized legal arguments and supporting evidence aimed squarely at the government's stated concerns.

  • Specialty occupation issues
  • Employer-employee relationship concerns
  • Job duty documentation
  • Wage and worksite questions
  • Business operations evidence
  • Employee qualifications
  • Maintenance of status issues
  • Investment or business viability questions

Compliance doesn't end when a petition is approved. Employers must follow immigration rules before, during and after filing — employment eligibility verification, job duties, wages, worksites, public access files, DOL requirements, representations made to USCIS and ongoing documentation. We help employers understand and manage those responsibilities so they can reduce risk while still meeting workforce needs.

Frequently asked questions

Do you represent the company or the employee?

In employment-based cases we work with employers on the petition side — strategy, filings, documentation and compliance — while coordinating closely with the sponsored worker, both sides have to supply evidence and meet deadlines. We'll explain the relationship clearly at the outset.

We've never sponsored anyone before. Where do we start?

Start with a consultation before you make an offer or set a start date. We'll look at the role, the candidate's credentials, your business operations and your timing, then lay out which visa categories realistically fit and what each one requires.

What happens if we get a Request for Evidence?

Don't panic, and don't miss the deadline. We review exactly what the government is questioning — specialty occupation, wages, worksite, the employer-employee relationship, business viability — and build a response with organized legal argument and supporting documentation.

Can you help with seasonal or agricultural labor?

Yes. We handle H-2A agricultural worker matters and H-2B temporary nonagricultural matters, including DOL and FLAG-related filings, recruitment steps, wage obligations and the timing these programs demand.

Do you work with investors and business owners, not just employers hiring staff?

We do. Entrepreneurs and investors may have options tied to business ownership, investment, job creation or a specialized business plan, including E-1 visas and other investment visa routes. We help evaluate the strategy and prepare documentation supporting the business purpose and eligibility.

Which states do you serve?

Businesses in Arizona and New Mexico, and beyond. The firm has offices in Goodyear, Arizona and Albuquerque, New Mexico.
